The terms "We" / "Us" / "Our"/ "Company" individually and collectively refer to DK Infotech Solutions Pvt. Ltd. and the terms "Customer”/”User” refers to the Client.Project Terms
All quotes are based on the company’s understanding of the client’s requirements and timeframe. Any changes, including minor ones, may incur additional costs. Clients must ensure all requirements are clearly communicated and agreed upon before work begins, as discrepancies later may lead to extra charges. Delays caused by the client can affect project timelines and costs. Bug fixes during or shortly after development are free, but rework or changes after approval will incur charges. Content must be provided within two weeks to avoid delays. Testing is done on common browsers and devices; other requirements should be communicated in advance. Third-party costs (e.g., hosting, payment gateways) are not included in quotes. Projects stalled for more than two months incur administrative fees. Intellectual property rights to software code belong to DK Infotech, with transfer only upon full payment and under specific usage conditions. Communications are primarily through email or WhatsApp, and clients must keep contact details updated.Annual Maintenance Package Terms:
All maintenance packages are for a 360 days period. Maintenance packages are billed annually. Packages include 360 days basic website hosting, email hosting. Packages are designed to serve website maintenance tasks only. Does-not include any Digital Strategy, Business Analysis, Solution Architect, SEO and any modification work. Any extra work billed separately @ Rs200/hour excl. GST. Support requests need to be sent via email to Any urgent tasks will be charged separately.Payment terms:
Payment terms: Annual maintenance package require payment before 15 days of expiry date. In case of non payment till the renewal date the service will be the service will be discontinued, data will be deleted, and domain will not be renewed (if purchased by us and client will be resopnsible of the domain if it has been registered by any other). An administrative fee of Rs10000 will be charged to the client if he wants to get the data. There are absolutely no refunds for any service.Termination:
In case Client need to cancel renewal, please inform us in writing (email) at least 10 days prior to the renewal date. We reserves the right to terminate annual maintenance at anytime with written notice to the Client.Domains:
Clients are responsible for all domain registrations and renewals. If DK Infotech is instructed to purchase a domain, clients accept the related terms, including the risk of service disruption or loss if domains expire or are purchased by others. Payments must be made at least 10 working days before expiry, and unpaid or late payments are client's responsibility. Domain control panel access is not provided as domains are held in a common pool. Transfer of domains to client accounts requires full payment and a Rs 1000 administration fee. Project copyrights can be transferred to clients at an additional cost after full payment and acceptance, but the company reserves the right to refuse transfer under irregular circumstances. Clients are responsible for content copyrights, and copyrights transferred do not include rights to reuse or resell code. Ownership transfer in business changes is allowed only under restrictions forbidding resale or reuse. The company’s CMS cannot be transferred to external hosts.Warranty:
The server typically handles 1,000 page views per hour (24,000 per day), with additional resources available at extra cost. Clients are responsible for their own data backups. While DK Infotech strives to protect against hackers and service disruptions, it is not liable for data loss or interruptions. All disputes are subject to patna jurisdiction. The company reserves the right to change terms without notice. Images and logos may be protected by copyright.Server Management Terms & Conditions
1. Scope of Services
The Service Provider agrees to manage, monitor, and maintain the Client’s server infrastructure. Services may include:
- Server setup, configuration, and deployment
- Performance monitoring and optimization
- Security management (patching, firewall, access control)
- Backup management (if agreed)
- Troubleshooting and technical support
2. Access & Credentials
- The Client shall provide necessary server access (SSH, control panel, cloud access, etc.).
- The Service Provider will ensure confidentiality of all credentials.
- The Client is responsible for maintaining ownership of accounts and root access.
3. Service Availability
- The Service Provider will make reasonable efforts to ensure uptime and performance.
- However, 100% uptime is not guaranteed due to factors beyond control (hosting provider issues, network outages, etc.).
4. Security & Responsibility
The Service Provider will implement best practices for server security.
The Client acknowledges that:
- No system is completely secure
- The Service Provider is not liable for breaches caused by:
- Weak passwords
- Third-party software vulnerabilities
- Client-side negligence
5. Backups & Data Responsibility
- The Service Provider may maintain rolling backups of server data for up to the most recent six (6) months
- These backups are provided as a convenience and are not guaranteed to be complete, error-free, or recoverable in all situations.
- The Client acknowledges and agrees that long-term data storage, archival, and maintenance remain solely the Client’s responsibility.
- The Client is advised to maintain independent backups of all critical data.
- The Service Provider shall not be liable for any data loss beyond the available backup period or due to failure of backup systems, unless caused by proven negligence.
7. Support & Response Time
- Support will be provided during agreed working hours (or 24/7 if defined).
- Emergency issues will be prioritized.
- Response and resolution times may vary based on issue complexity.
8. Prohibited Use
The Client agrees not to use the server for:
- Illegal activities
- Spamming or phishing
- Hosting malicious or harmful content
- Activities violating local laws
9. Payment Terms
- Fees shall be paid as per agreed schedule (monthly/quarterly/etc.).
- Delayed payments may result in suspension of services.
10. Limitation of Liability
- The Service Provider shall not be liable for:
- Indirect or consequential damages
- Loss of business, revenue, or data
- Maximum liability shall be limited to the fees paid for the service period.
11. Termination
- Either party may terminate the agreement with prior notice (e.g., 15–30 days).
- Upon termination:
- Access credentials will be handed over
- No further responsibility lies with the Service Provider
12. Confidentiality
- Both parties agree to keep all sensitive information confidential.
- This obligation survives termination of the agreement.
13. Amendments
- Terms may be updated with mutual consent in writing.
14. Governing Law
- This agreement shall be governed by the laws of India.
- Any disputes shall be subject to jurisdiction of Patna, Bihar courts.
